Taking Steps to End Cashless Bail to Protect Americans
Order 14342 directs federal agencies to compile a “list of States and local jurisdictions that have, in the Attorney General's opinion, substantially eliminated cash bail as a potential condition of pretrial release from custody for crimes that pose a clear threat to public safety and order.” Agencies are then directed to scrutinize all federal grants those jurisdictions receive to see if any can be lawfully suspended or terminated. While the order makes clear that agencies are to comply with the law regarding grant awards and administration, there is the potential for agency officials to effectively tie non-statutory strictures to funds in ways that violate federal law.
