Enabling Competition in the Commercial Space Industry

Order 14335 aims to increase development of U.S. commercial space launch capacity by directing federal agencies to examine possibilities to use federal facilities and lands for this purpose, and to expedite environmental and other approvals. Where implementation could infringe on state and local authority concerns the provision directing agencies to scrutinize whether state coastal management plans formulated under the Coastal Zone Management Act (CZMA) obstruct the development of launch capacity. The CZMA is a joint governance program states can choose to participate in by submitting a plan to the federal government for approval. While this does indicate that ultimate authority for coastal zone management lies with the federal government, federal efforts to force modification or revocation of state plans could reduce the authority some of them have exercised for decades.
